ModelGenius Privacy Policy

This Privacy Policy describes how ClassGenius, Inc., a Delaware corporation, acting through its ModelGenius offering (“ModelGenius,” “we,” “us,” or “our”), collects, uses, discloses, and retains information in connection with the ModelGenius websites, including modelgenius.ai (the “Site”), and the ModelGenius platform, applications, and related services (together, the “Service”).

Scope. This Privacy Policy applies only to ModelGenius. The ClassGenius educator products available at classgenius.ai are governed by their own privacy policy, available at https://tools.classgenius.ai/privacy. By using the Site or the Service, you agree to this Privacy Policy, which is incorporated into and forms part of our Terms of Service.

Our roles. ModelGenius is a business service. For information relating to your account and your use of the Site and Service, we act as the data controller (or equivalent). For the content our business customers submit to the Service — such as prompts, traces, and model outputs (“Customer Content”), which may include information about a customer's own end users or about its employees, contractors, and other personnel whose interactions with the customer's products or internal AI tools appear in submitted data — we act as a processor or service provider on the customer's behalf and process it in accordance with our agreement with that customer. If your personal information was included in data submitted by one of our customers (for example, a business whose product or service you use, or your employer), please direct privacy inquiries to that customer; we will assist them as required by law.

That documentation is provided for transparency and is updated as the Service evolves; this Privacy Policy governs our privacy practices.

4. Data Retention

We retain information for as long as needed to provide the Service, and thereafter as needed for legitimate business purposes such as developing and improving the Service, maintaining records for billing, tax, audit, and compliance purposes, resolving disputes, enforcing agreements, and securing the Service. Retention periods depend on the type of information, the purposes for which it is used, and applicable legal requirements.

The Service may offer customers configurable retention controls for certain data, and customers can delete data or their account through the Service; current options are described in our Data Handling documentation. Deleting your account removes your profile information and your stored content. Deletion of stored content (such as prompts, responses, and conversational data) is backed by destruction of the encryption keys protecting it, and residual copies of deleted content are purged from backups in the ordinary course, currently within 30 days. When information is deleted, we may retain de-identified or aggregated data, and records we are required or permitted to keep for legal, billing, audit, security, and dispute-resolution purposes.

We maintain administrative, technical, and physical safeguards designed to protect information against unauthorized access, disclosure, alteration, and destruction, appropriate to the nature of the information and the risks involved, including encryption of data in transit and at rest. A description of our current security practices is available in our security documentation. No system is completely secure, however, and we cannot guarantee the absolute security of any information. If we become aware of a breach of security affecting your personal information, we will notify you and the relevant authorities where required by applicable law.

Depending on your jurisdiction, you may have rights regarding your personal information, such as the right to access, correct, delete, or receive a copy of it, to object to or restrict certain processing, and to opt out of certain uses. Many choices are available directly in the Service: you can review and update your profile, manage available retention settings, delete data or your account, and unsubscribe from marketing emails using the link in each message.

We will verify and respond to requests as required by applicable law, and we will not discriminate against you for exercising your rights. If we hold information as a processor for a customer, we will refer your request to that customer and assist as required. You may also have the right to lodge a complaint with a supervisory authority in your jurisdiction.

The Site and Service use cookies and similar technologies to operate and secure the Service, remember preferences, and understand how the Site and Service are used, including through third-party analytics providers. Some cookies are strictly necessary for the Site to function; others support analytics and product improvement. You can manage or block cookies through your browser settings, though some features may not work properly without them. We do not use cookies for cross-context behavioral advertising. Like many websites, the Site does not currently respond to “Do Not Track” browser signals.

We are based in the United States and process information in the United States and in other locations where we or our service providers operate. Where required by applicable law, we implement appropriate safeguards for cross-border transfers, such as contractual protections.

The Site and the Service are business tools intended for use by organizations and their adult personnel. They are not directed to children, and we do not knowingly collect personal information from anyone under 18. We may update this Privacy Policy from time to time. When we do, we will post the updated version on the Site and revise the “Last Updated” date. If we make material changes, we will provide additional notice as required by applicable law, such as by email or a notice within the Service. Your continued use of the Site or the Service after the effective date of an updated Policy constitutes acceptance of it. If we make a material change to this Privacy Policy that expands how we use personal information collected before the change, we will obtain any consent required by applicable law before applying that change to the previously collected information. Updates to our documentation, Data Handling explainer, and similar materials describe how the Service operates within the purposes disclosed in this Policy and are not changes to this Policy.
