ModelGenius Privacy Policy

This Privacy Policy describes how ClassGenius, Inc., a Delaware corporation, acting through its ModelGenius offering (“ModelGenius,” “we,” “us,” or “our”), collects, uses, discloses, and retains information in connection with the ModelGenius websites, including modelgenius.ai (the “Site”), and the ModelGenius platform, applications, and related services (together, the “Service”).

Scope. This Privacy Policy applies only to ModelGenius. The ClassGenius educator products available at classgenius.ai are governed by their own privacy policy, available at https://tools.classgenius.ai/privacy. By using the Site or the Service, you agree to this Privacy Policy, which is incorporated into and forms part of our Terms of Service.

Our roles. ModelGenius is a business service. For information relating to your account and your use of the Site and Service, we act as the data controller (or equivalent). For the content our business customers submit to the Service — such as prompts, traces, and model outputs (“Customer Content”), which may include information about a customer's own end users or about its employees, contractors, and other personnel whose interactions with the customer's products or internal AI tools appear in submitted data — we act as a processor or service provider on the customer's behalf and process it in accordance with our agreement with that customer. If your personal information was included in data submitted by one of our customers (for example, a business whose product or service you use, or your employer), please direct privacy inquiries to that customer; we will assist them as required by law.

That documentation is provided for transparency and is updated as the Service evolves; this Privacy Policy governs our privacy practices.

1. Information We Collect

We may collect the following categories of information:

• Account and profile information. Information you provide when you request access to, register for, or administer an account — such as name, email address, organization, role, and settings.

• Payment information. Billing details and payment method information, which are processed by our payment processors; we do not store full payment card numbers.

• Customer Content. Content submitted to the Service by or on behalf of a customer, such as uploaded traces, prompts, model responses, files, configurations, and inputs to conversational features, whether originating from the customer's products or from its internal workflows, agents, and tools.

• Derived and de-identified data. Data we generate in operating the Service, such as de-identified categorizations of prompts and request-level metadata (for example, token counts, latency, and model used). This data is designed not to include or reveal the content of prompts or responses.

• Communications. Information you provide when you contact us, respond to surveys, participate in interviews, calls, or feedback sessions, or participate in programs such as early access — including contact details and the content of your messages and feedback.

• Usage and device information. Information collected automatically when you interact with the Site and Service, such as IP address, browser and device type, pages viewed, features used, and diagnostic logs, collected through cookies and similar technologies as described in Section 7.

2. How We Use Information

We may use the information we collect to:

• provide, operate, maintain, and secure the Site and the Service, including running validations, generating reports, and providing customer support;

• set up and administer accounts, process payments, and send transactional and administrative communications;

• develop, improve, and analyze the Site and the Service, including through de-identified and aggregated data;

• communicate with you about products, features, and offers, subject to your right to opt out of marketing communications at any time;

• monitor for, prevent, and address fraud, abuse, security incidents, and violations of our terms; and

• comply with legal obligations and enforce our agreements and legal rights.

We do not use Customer Content to train foundation or general-purpose AI models, and we do not permit third-party model providers to do so, unless the customer expressly opts in.

3. How We Disclose Information

We do not sell personal information, and we do not share personal information for cross-context behavioral advertising. We may disclose information as follows:

• AI model providers. The Service uses third-party AI model providers in two ways. To operate the Service — for example, to analyze and categorize submitted traces and to construct validation plans and estimates — we process customer data using the providers identified in our documentation for those functions. To validate prompts against candidate models, the Service transmits customer prompts to the model providers the customer has placed in scope, and does not send prompts to a candidate model provider the customer has not approved. In both cases, providers are subject to data-handling requirements described in our agreements and documentation, including the restriction on training described in Section 2.

• Service providers and subprocessors. Vendors that perform services on our behalf — such as cloud hosting, payment processing, communications, analytics, and support — under contracts that limit their use of the information to providing those services.

• Within our company. Among personnel and corporate functions of ClassGenius, Inc. as needed to operate the Service, consistent with this Policy.

• Corporate transactions. In connection with a merger, acquisition, financing, reorganization, or sale of all or part of our business or assets, in which case the successor's use of the information remains subject to this Policy or a successor policy consistent with applicable law.

• Legal and safety. Where we believe disclosure is required or permitted by law or legal process, or appropriate to protect the rights, property, or safety of ModelGenius, our customers, or others, or to enforce our agreements.

• With direction or consent. At the direction of the customer that controls the data, or otherwise with consent.

4. Data Retention

We retain information for as long as needed to provide the Service, and thereafter as needed for legitimate business purposes such as developing and improving the Service, maintaining records for billing, tax, audit, and compliance purposes, resolving disputes, enforcing agreements, and securing the Service. Retention periods depend on the type of information, the purposes for which it is used, and applicable legal requirements.

The Service may offer customers configurable retention controls for certain data, and customers can delete data or their account through the Service; current options are described in our Data Handling documentation. Deleting your account removes your profile information and your stored content. Deletion of stored content (such as prompts, responses, and conversational data) is backed by destruction of the encryption keys protecting it, and residual copies of deleted content are purged from backups in the ordinary course, currently within 30 days. When information is deleted, we may retain de-identified or aggregated data, and records we are required or permitted to keep for legal, billing, audit, security, and dispute-resolution purposes.

5. Security

We maintain administrative, technical, and physical safeguards designed to protect information against unauthorized access, disclosure, alteration, and destruction, appropriate to the nature of the information and the risks involved, including encryption of data in transit and at rest. A description of our current security practices is available in our security documentation. No system is completely secure, however, and we cannot guarantee the absolute security of any information. If we become aware of a breach of security affecting your personal information, we will notify you and the relevant authorities where required by applicable law.

6. Your Rights and Choices

Depending on your jurisdiction, you may have rights regarding your personal information, such as the right to access, correct, delete, or receive a copy of it, to object to or restrict certain processing, and to opt out of certain uses. Many choices are available directly in the Service: you can review and update your profile, manage available retention settings, delete data or your account, and unsubscribe from marketing emails using the link in each message.

To exercise other rights, contact us at support@classgenius.ai. We will verify and respond to requests as required by applicable law, and we will not discriminate against you for exercising your rights. If we hold information as a processor for a customer, we will refer your request to that customer and assist as required. You may also have the right to lodge a complaint with a supervisory authority in your jurisdiction.

7. Cookies and Analytics

The Site and Service use cookies and similar technologies to operate and secure the Service, remember preferences, and understand how the Site and Service are used, including through third-party analytics providers. Some cookies are strictly necessary for the Site to function; others support analytics and product improvement. You can manage or block cookies through your browser settings, though some features may not work properly without them. We do not use cookies for cross-context behavioral advertising. Like many websites, the Site does not currently respond to “Do Not Track” browser signals.

8. International Data Transfers

We are based in the United States and process information in the United States and in other locations where we or our service providers operate. Where required by applicable law, we implement appropriate safeguards for cross-border transfers, such as contractual protections.

9. Children

The Site and the Service are business tools intended for use by organizations and their adult personnel. They are not directed to children, and we do not knowingly collect personal information from anyone under 18. If you believe a child has provided us personal information, contact us at support@classgenius.ai and we will delete it.

10. Changes to This Privacy Policy

We may update this Privacy Policy from time to time. When we do, we will post the updated version on the Site and revise the “Last Updated” date. If we make material changes, we will provide additional notice as required by applicable law, such as by email or a notice within the Service. Your continued use of the Site or the Service after the effective date of an updated Policy constitutes acceptance of it. If we make a material change to this Privacy Policy that expands how we use personal information collected before the change, we will obtain any consent required by applicable law before applying that change to the previously collected information. Updates to our documentation, Data Handling explainer, and similar materials describe how the Service operates within the purposes disclosed in this Policy and are not changes to this Policy.
